yeah i think they have offered a refund or a replacement (although for rare shell a replacement isn't possible)

I believe these ran me about $1300 so I would happily take a refund if that was an option.

Sort of, yes. I do think it's a design flaw. I have not had any that have failed even remotely to this extent, however. But this type of failure is precisely what I was worried about.

I don't think it specific to Alden, because I had a similar issue with a different manufacturer that I caught early enough to call customer service. Apparently it happens when last is removed from the boot.

It looks like your pair tore right along the quarter stitch line. Mine is inboard of that area in the no mans land between the line of stitching for the tongue and the quarter. I feel like mine looks like more of a cut but it could be a split from lasting perhaps.

I still think this is a design flaw though because the lining isn't connected in any way to the upper leather in this small section. I feel like that makes this area much weaker. The pic below is a brand new shoe. As @jischwar mentioned, I have a much older pair that I had reinforced by a cobbler in the exact same spot after I discovered basically the same exact thing. He removed part of the quarter stitching, then stitched this area to the lining which he seemed to think would be more than sufficient for preventing it from getting worse.

I haven't decided what I am going to do about the new pair yet.
