Based on my indepth knowledge of diplomatic law from Lethal Weapon 2, why cant DSK invoke diplomatic immunity? After all, in that movie, didnt the South African ambassador murdered Mel's girlfriend and claimed immunity by flashing his passport?
And how likely is DSK going to do a Polanski once he gets the chance?
I've heard conflicting reports about the immunity. The IMF's articles supposedly grant him limited immunity in re work-related matters, but he may benefit from full immunity under earlier treaties covering the heads of UN agencies.
In either event the IMF could just waive immunity. In many other cases, even if immunity wasn't waived the official was still charged in their home jurisdiction"”I recall a drunk driving case involving a Russian diplomat in Ottawa a few years ago. But the IMF isn't a state with its own judicial system (he'd just go free), so I don't know why they'd go out on a limb for him, and I don't know why he'd risk looking like an even bigger jerk in the face of a possible trial.
