that's a healthy looking cat, probably not a stray. I'd put him in the back yard and see if he goes home. If he's still there tomorrow you have yourself a cat.

Honestly, I have no idea how to tell (I can tell on a human, but not a cat). There were some guys moving who checked, though, and seemed to think he was a male.

If the cat were an intact male, you could definitely tell, given that he (?) is a short-haired cat. A lady friend of mine once adopted a cat she was sure was a "she" and took "her" in to be spayed, only to learn that he was neutered male.
I definitely do not want a new friend for life. I hope he gets picked up soon.
I'm not sure I could give him the attention that he probably needs.
