Help with boot fit?

Hey guys,

I'm not even sure if there is help to be had.

I bought a pair of John Varvatos (mainline) boots on ebay, NIB, about a month ago at my regular size, 10.5 US. When I got them, they fit large on me. Ok, fine. I sent them back and was told my needed size (now 10.0) wasn't available.

Fast forward to last week, when I bought a new pair of John Varvatos (mainline) boots, slightly different style.

Again, they seem to big, even though 10.0! The width and length seem good at the toe/mid part of my foot, but when I walk, my heel comes up about 1/2 inch.

Should I even try a 9.5 (!!) or is it a width thing? These are "medium" width (D, M). Or are these boots just not going to work? I don't care to keep playing the shipping/return game if it's a waist of my time.
