Foie is an off the menu item at my favorite locally owned place. We have two portions waiting for us for dinner in a few days :)

What are the particulars of the ban -- is is just banned from restaurant service, or are production and sale for home consumption also banned?

As far as I understand it, you're not allowed to produce or sell it. However, you can import it from other states. And you're allowed to eat it.

Correct. No sale or production. I wonder if, like with computer software, restaurants will license, rather than sell it to customers.

I just heard a local report on our NPR station this morning about the non-enforcement of this law. Apparently, except for maybe San Francisco, the people who are supposed to enforce this law are going to mostly look the other way.

They mentioned the restaurant in the Presidio claiming an exemption and still serving foie. Other restaurants are offering free foie dishes if you order other things, and some others will prepare it for you if you bring it in since it's not illegal to distribute and buy it.
