Yikes, what a terrible situation.

That isn't the case here. We've had a couple talks about it and they've ensured me that they won't claim me this year (at least on their taxes lol). They've never been anything less than supportive of me. They were going to pay for my schooling way back when I first started, but after three years of not taking it seriously, they told me that if I wasn't going to take my education seriously, then they weren't either.
I don't really mind paying for school as it is now. Having a fulltime job for the last year actually gave me a huge leg up even though I joke about being broke all the time.
It's nice to be an adult and do something on my own though.

In my experience as a student and faculty (this is all becoming quickly dated and rules may have changed), you need only not be claimed by your parents on their taxes to be considered independent.

I got an email from my old company's HR Manager yesterday, saying that she knew I was in class all day but to call in if I got the chance.
So I called in before class today and got a hold of her. I figured this would be bad b/c I should have gotten my last check on Friday, with 16 hours of work and 56 hours of unpaid vacation time.

Well when I called her (she's an amazingly nice lady, we've always gotten along well) she tells me that she has bad news she doesn't want to deliver. Turns out Mr. Schilli (owner of the company) isn't going to pay me for any of those earned vacation hours. When I started working there last May, him and I signed a contact with each other saying that I was fired on August 15th, 2008, for the purposes of going back to school fulltime. In that contract, there is absolutely no mention of benefits whatsoever-- nothing saying I'm entitled to them, nothing saying I'm not. Apparently he says that since I was hired on as "temporary work" with an agreed upon end date, I should not have been made eligible for any benefits. So after my 90 day original probationary period, I signed up for healthcare and 401k and FSA. He thinks that I should not have been able to do that.

Then, after I'd been there for a full calendary year, I became eligible for 10 paid vacation days, per the company's policy. I used 3 of them, leaving 7 to be given to me on my final check.


Another point in his "rationale" if you choose to call it that, is that when I started, I was working in Remington (a mile from my house) for $8/hr. Then, after 2 months, I got transferred to Lafayette (45 miles from home) and I negotiated a higher salary with him for that b/c I couldn't afford gas on only $8/hr. So he gives me a raise to $10.50/hr. Then, after working there for 2 months, another department was having problems (I was the kind of guy he just sent around to different departments with problems to help fix them, like a pinch hitter I guess) that was back in Remington. I worked in Remington again for a month before going back to Lafayette for the rest of the 10 months until my end date. He says that since I negotiated a raise when going to Lafayette, but didn't go back to my original payscale when going back to Remington, that I also should not be eligible for the vacation days.

So that's about $500 bucks I'm out. So now instead of getting a paycheck (that's already a week late) for $630, I'm only getting $130 for 2 days of work.

I'm so ******* pissed I could cry. This is ridiculous.


Oh, I should mention that when I went back to Lafayette, I was promoted to facility manager of the Lafayette offices and worked in that position for the final 5 months of my employment, all the while doing it for the original $10.50, not asking for a raise even though there were huge raises in responsibility.

Kwilk---isn't your dad a bigwig there? He has no pull, or are perhaps you getting screwed because he doesn't want the appearance of nepitism by proxy?

Was their any verbal discussion or agreement of benefits, vacation time, 401(k) at the time you signed the contract?

My father is a bigwig. Vice-President. Second in line behind the owner. However, I got the job without any help from him, actually, against his will, and I only feel it would be proper to handle this like a big boy without crying to daddy.

There was no verbal discussion or agreement of benefits. It just never came up, whatsoever. So I (and the HR manager) assumed that we were to follow the company handbook for guidance since there was nothing else to go on. I participated in the health insurance plan and 401(k) and the health savings account and nobody mentioned a problem. I got paid for those 3 vacation days without a problem.

This weekend I'm going to write a letter outlining why I believe I'm entitled to that vacation pay and to ask them to reevaluate the situation. Depending on the response there, I will decide what to do moving forward.

My dad being a bigwig there makes this situation even harder. I'd never in a million years ask him to take it up with the boss, but at the same time, I have to walk on eggshells in how I deal with this, b/c no matter what happens, it will have ramifications for my father, even if it is only personal animosity between him and the owner.

Exactly - if you're ethical about it, then you're dad being in the same company makes the "rules of engagement" so much more difficult. But you can't tie your hands behind your back and thus do yourself a disservice by over-compensating for your father's presence in the company.
