Just checking how others would respond in this matter. Have posted some pictures earlier in the "recent purchases" thread.

When I complained about the condition of the shoes received, the seller tells me the auction was honest and clear and he does not accept returns. According to me the auction wasn't clear about the actual amount of wear of these shoes and them being subs.

Would you have expected these shoes to be in this condition when looking at the auction details and provided pictures?

I have opened a SNAD case on eBay, wonder how it will be ruled as buyer and myself both think we have a strong case.

It's not even the same pair of shoes is it? The Ebay photos they look excellent, but what you received, it looks like someone has been chewing them. You should win this one.

If you look closely at the pics the seller provided, you can tell where they've cropped out the flaws. The inside heel photos taken by OP vs those on this listing are especially telling.

'Beautiful condition' my arse. Best of luck with your SNAD, OP .. not that you'll need it, because any old bozo can see just how creative the seller's photography and/or PS skills are.

SLAM DUNK, you should win this. Cropped photo not to show the wear on the inner heel. And the description makes it sound like they are perfect.

"The stitching is in MINT condition and there is only a very slight scuff on one heel, so minor that my camera cant pick it up clearly enough to show on the listing! " His camera is broken if it couldn't pick up any of that...

eBay should (and in all likelihood will) find in your favor. If they don't, file a dispute with your credit card company.

Sheesh, maybe seller sent you the wrong shoes. If not, very dishonest seller. An honest seller would have written an auction page that read like:

"Today we have a fine deal for a pair of trashed, busted up, worn out pieces of ****. I guarantee you will be pleased with this purchase, and the price at 1/3 off full retail is very reasonable. Thanks for bidding.".

The sellers reply to my SNAD case where I described the shoes as worn down and damaged (and added pictures):

'Im sorry, i do not agree with your description of the shoes at all. They are beautiful and in fantastic condition for second-hand shoes. i did not sell these shoes as new. I only stated that when new they are £300. I clearly displayed the shoes- upper and lower and sole for the buyer to make a decision over before buying. They were cleaned and polished before I sent them to you immediately after payment. I felt extremely bad that you were disappointed with the shoes when they arrived and apologised profusely and offered you a near-60% refund. You declined and I feel now you have exaggerated your concerns obviously due to our Ebay case. I rang Ebay as i was so concerned with your communication and I would now like for Ebay to assess the case as I feel I am not obliged to refund you as the item was clearly described.

Thats awesome, he put the case to ebays discretion. Expect a refund in about a day. Or at least the email saying you win if you ship them back SIGNATURE REQUIRED.

If ebay does side with the seller, are there any consequences to requesting a charge back from the credit card company? That is, if visa refunds your money, then do they go after ebay/original seller?

My response:

No comment other than the fact that the pictures I took say enough. Read your item description and look at these pictures and tell me who is wrong.

You may have cleaned and polished them, but that does not change the fact that the soles are separating from the uppers and the heels are worn down completely to the part where the rubber is attached to the leather base of the heel. Also, the giant tear on the inside of the heel and the cracked leather surrounding it are nowhere near what I expect of used shoes in "beautiful and in fantastic condition".

You say no word about not disclosing the fact they are subs, which is a huge issue to me: I do not want to own a product which does not meet the quality standards of it's manufacturer and are found unworthy to sell themselves.

Can you honestly say that you bought these shoes 10 months ago new for 300 UKP and only used them for one month and then stored them in a cupboard for 9 months before selling them on eBay? The pictures say otherwise.

Seller responded again :fence:

'I can honestly say they are 10 months old and were warn for 1 months (5 weeks) the sole and tears were not coming away when I sent them. They were in great used condition- as the description told you. I am not insinuating that you have altered the shoes, please dont get me wrong, but we obviously disagreeing on the value and state of the item. The subs issue is neither here nor there as sold the shoes as secondhand/used and photographed the soles on the listing. I did apologise profusely for for not realising the stamp meant that they have been deemed imperfect but this is usually for a 3mm or smaller imperfection in the leather upper. it is certainly not a reason for the shoes to be unwearable. I just cannot agree with you no matter what angle you have take the photos at. I listed the item with full description and 5 pictures and stated 'no refunds', it is the buyers choice to go ahead and purchase. Let Ebay decide now as there employee I spoke to said I had done nothing wrong.'

Now I am puzzled: How the hell can you totally wear down a new pair of C&J in 5 weeks? These shoes look worse than some of my shoes I own for more than 4 years.

Don't know, but will find out if eBay does side with the seller because I'm going to escalate to Visa then.

Curious thing is the seller does have good feedback. Did he just send the wrong shoes and has not twigged on it yet?

This happened to me when I complained to a seller for sending me trashed goods. I suggested to seller he may have sent me wrong item, and later on the seller was like "oh boy, I messed up good here". Seller paid for return shipping and I got the original item, and all was hunky dory.
