Id need a 46 . thinking even in a 46 slim fit my shoulders.arm fit would be too tight

If you can identify the model name from the inner tag, that should help. (i.e. Bertolluci, spirit, etc...)

I really hate when they do that - false advertising

Assuming it's not pinned at the back, my best guess is that this is one of their "modern fit" suits (in this case sold as a separate). Looks like a "James" or possibly "TheJam75". You should be able to find it significantly discounted if you look around, even if it's current season.

Edit: LOL Xenon beat me to it. Likely pinned.

I'm wondering if it is that difficult to make suits that fit like in picture without getting them pinned in the back?

Not that hard but it wouldn't fit a growing number of men. Most of my RTW suits now fit like in the picture with some serious heavy altering from a competant tailor. I really had to push my tailor to increase the waist suppression well past his comfort zone though and there were several failled attempts along the way with other tailors.
