Beware of ebay seller LUXURYHUT...Asking forum suggestions.

On January 25th, ebay seller Luxuryhut and I agreed on a price ($380) for a BNWT Tanner Krolle jewelry box he listed on ebay. I paid him directly via paypal with my credit card the same day. I received the item on Jan 31st. However, the quality of the item was not I expected, comparing the leather quality/hardware with one Tanner Krolle item I have. More importantly I examined the box inside and out and could not find any label/stamp/logo identifying the maker. So I contacted the Tanner Krolle store in London (+44 (0)207 529 5822). A gentleman from the store confirmed it was a fake since the company had never made any products without its stamp/label on them in its entire 150 years of history. For a jewelry box, there should be a stamp saying "Tanner Krolle" at the bottom of the box if it were made by Tanner Krolle. So I wrote a message to Luxuryhut explaining what I had learned from the Tanner Krolle store and questioning its authenticity. The next day Luxuryhut wrote me back denying any authenticity problem, but told me he would accept return for a full refund. I sent the item back on Feb 3rd via USPS priority international mail with full insurance coverage. It cost me $45. I know paypal policy, the best I can ask for is a full refund. So I didn't even ask for return postage. I wrote a message to luxuryhut informing him the return package and tracking number. - The tracking indicated the postal had attempted delivery on Feb 9rh. However, I didn't hear from him at all, so on Feb 13th I wrote him a message inquiring about the refund. - He replied on Feb 14th claiming that he had not received item yet, and asked me for the tracking number. - I wrote him back on the same day (Feb 14th) telling him the package was at his local postal office. I gave him the tracking number again, and attached the entire tracking info from USPS website. - He wrote me back on Feb 15th telling me that he had not received any notification. And He asked me to request postal office to leave him another note. - I traced the package via Canada Post online tracking and located his local postal office address/phone number. I contacted Canada Post at 1-866-607-6301. Canada Post customer service told me that all he needed is to call this same toll free number, and they would give him all the information to pick up this package. I sent him a message on Feb 15th at 12:00 pm giving him all these information. - He wrote back on Feb 15th (Wednesday) -" We did not receive this notice, and it is strange that they kept trying to deliver at night in a commercial location. Anyway, the parcel is at a pick up location. My rep is trying to see if he can get me a pick up tag based on the tracking number you gave me. Hopefully we should be able to pick up by Monday. " - On Tuesday morning (Feb 21st), I asked him again about the refund status. - He wrote back on Wednesday (Feb 22nd) - "I cannot refund you until I receive the item, which I will do asap once I receive it. I already have another customer that wants it and is aware there is not logo, so believe me I want to finish with this. I was supposed to get a pick up notice when they tried to deliver, which I did not get (hence the reason for this whole issue). My rep at Canada Post was trying to get me a copy so that I can pick it up. They just advised me as follows. They will be sending me a final notice to pick up the item within the next few days (within 2 weeks of original attempt).?this is automatic. I need this notice to pick up the item." - I contacted Canada Post again, and wrote him back - (early Wednesday afternoon, Feb 22nd) - "I could not believe this! I just called Canada post at 1-866-607-6301 (the number I also gave you a week ago). I spoke with a gentleman whose name is Nathan. He gave me the package notification number: 103393445008118. All you need is this notification number with a valid ID to pick up this package. Your local postal office address: PHARMAPRIX # 1973 2445 CH LUCERNE MONT-ROYAL QC H3R 2K0 Even with all the information I supplied, I bet you would give me some other reasons for not picking it up.'' Honestly, at that point, I was feeling this guy had been and would give any excuses to avoid picking up the package, and thus not process my refund. - He replied me back Thursday morning - "I was told I need the pick up tag by my rep at Canada Post. STOP ACCUSING ME OF TRYING TO AVOID THIS. Check my feedback against yours. I will try your way and go there tomorrow. This is an office though, so what ID I should bring I do not know, but I will go there myself and try it." - The last message I received from him was yesterday morning (8:47am) - "...I told you I would go pick it up and refund you immediately thereafter. I will have it done soon, just trying to find time to go there. Hard since I am alone again today." So far, no refund. And I just checked the USPS website, it says the package on its way back to me. Thanks for reading this long story. Guys, what is your opinion? and what is your suggestion?

Did not catch the "filed Paypal SNAD" part yet? What is the time limit for refunding through Paypal? Sounds like he is playing a delaying game until your time runs out to file a SNAD. If you have not done it yet, do so when that package returns to you.

I don't know why you are putting up with this joker, I would just open a claim with PP and even ask for your return money. I've been able to get my return shipping cost refunded in the past. The best thing would be to get an instant credit from your CC company though. If you are using AMEX or Discover, they usually give instant credit.

Why not just initiate a chargeback with your CC provider?

Careful with Bank of America (zombie bank). Even with a Bar Association card, I was the victim of an Airline charging outrageous and undisclosed fees that may BoA did not chargeback. I even drafted an 11-page letter explaining and detailing as such.

Long story short: the lesson is that some banks are better than others, and some like Bank of America are greedy, incompetent, and unhelpful. In other words, try to resolve it before pursuing a chargeback because some banks like BoA do not help.

Problem is, you might be screwed if you sent it by Priority. PP disputes (where it sounds as this is going) only accept signature confirmation for receipt. Priority mail to Canada does not provide signatures. Express does, which would have only been another $5-$10 more to send. If he knows this and is avoiding the package, its not looking pretty.

I called Canada Post, and I was told the package required signature. (As my package was fully insured at $380). Even with USPS Express international mail, should the guy play the same game avoiding receipt of the item, the result would be the same, right?

That is right. I was very per-cautious as I didn't want to give the seller any excuse. I just didn't expect the seller being so dishonest & playing this dirty game. The tracking indicated that the postal office made quite a few attempts to deliver the package. However, the package required a signature. My guess is that the seller just gave an excuse not signing for the package (which would be very easy to do). And the mailman could not FORCE him to accept the piece.

This sentence is total bullshit. First of all, he absolutely does not need the pickup tag. I have picked up many times from my local outlet in a drugstore (as is the case here) without the tag. All you need is the postal code, the delivery address and your ID, assuming the delivery is in your name.

And regarding 'not knowing what ID' he needs to bring, this is even more bullshit. ID is ID in Canada, and 99% of the time that means driver's license or other government issued photo ID. If he is an Ebay seller with a few deals under his belt he knows this goddamn well, and they probably know him well at his local outlet.

You are being played. I have recently dealt with two dishonest sellers after some 80 deals here, all positive. In both cases, Paypal went to bat for me big time and once I showed that I was getting scammed, they refunded everything including my return shipping charges and even my duty charges. I hate Paypal for the fees but in this case I was glad I used them. I now use only a credit card through Paypal and will never again pay using a Paypal balance. You can contact them and see what they say. Do it before your time limits are up.

Hope you get a good result and that this thread does not discourage others from shipping to Canada. We're mostly decent people up here!
