A friend of mine in the UK decided to go buy a Patek Philippe off ebay, from here in Australia. Turns out it was fake, once you look at the pictures it is really apparent. So she was out of pocket $1000.

Seller is very apologetic, claims he doesnt know anything about the watch, and agrees to a refund. By this time 45 days of Paypal Buyer Protection have passed so she can't really do much. She ships the watch back to the seller, no contact from the seller.

This seller has excellent feedback in the 1000s and is still selling items.

What can she do at this point? A credit card chargeback?

did she file a claim with paypal before the 45 days were up? if she contacted the seller through the paypal dispute system, and had the conversation there then paypal will probably waive the 45 day limit. I've had it done before, although the amount was far less.

yes she needs to call paypal and also call her credit card company ASAP. if she doesn't start taking the right steps she will 100% sure be out the $1000.

Pateks don't usually cost $1000... even older, less popular models.

That's what I was thinking. I am not a huge watch person, but even I know that you can't possibly get a mint conditioned Patek for a grand. Sucks though that your friend got scammed. That's why I don't use ebay anymore and probably won't.

How does this happen out of curiosity? I know someone who posted a craigslist add for an iphone and got an offer from a guy in Georgia (the country) wanting to pay him a handsome sum via paypal for the phone. Naturally it wreaked of a scam, but I still don't know how it would have worked.

Yes, that was the first thing I told her. As soon as I heard that it was that cheap, I sorta suspected a scam.

I more or less stopped reading right there. Zenny, I understand it wasn't you who did this, but I still have to say:

That was pretty close to my reaction. First I thought it was a joke.
