I check everything I buy on eBay/B&S before I wear it. Innocent mistakes (and malicious deceptions) happen.

I mean ****, I may have even looked at one and it happened to be the 9. I guess when I go get the oil changed in my car, I don't drive home and check the dipstick to make sure they actually did it. When I order a hamburger, I just bite into it, I don't dissect it to make certain what I ordered is on or off of it. Hell, the car dealership once put the wrong sized tires on my car. I drove a little ways and took it back and said the car drives funny. They had put the wrong sized tires on the car. They changed it even though I guess it was my fault because I didn't check the little numbers on the side of each tire. How much caveat emptor is reasonable? Hell, don't advertise the shoes as 9s. Don't send me a box that has a big fuckin' 9 on the side. Say they might be 9s and I'd check them.

Everyone, huh? Good work Gallup. You still haven't explained how I actually destroyed the shoes by walking across the grassy knoll and am now trying dupe mbtopis.

I think it's fair to say that a new pair of shoes loses roughly half their value (in terms of resale) once worn.

Ok. In your opinion, what's the difference in value between a pair of matched shoes in a common size and a pair of the same shoes but mis-matched in size?

That's an accusation that I'm not being honest. I'd like you to either actually offer your opinion as to what I'm not being honest about or stop hinting that I'm not being forthcoming. Fell free to offer an opinion that I did something wrong, but just say it like an adult instead of this "MikeO did something wrong and I'll let you fill in the blanks" horseshit. Obviously a lot less. Probably in the neighborhood of 1/4 to 1/5th (that is, your $400 shoes might be worth 80 to 100 bucks).

I understand that your position in this matter is tough. But, there are measures that buyers on eBay must take on order to protect themselves. First, check everything you buy. Second, always document your returns (this includes photographs). Third, communicate fully with the seller before you return an item, including letting the seller know that you did in fact wear the shoes that rendered them no longer "new." At that point, you could have negotiated with the seller before returning them. At this point, you've lost most of your negotiating power. I doubt you will succeed with Paypal/eBay, considering you've already returned them. Small claims would likely work (breach of express warranty), but the cost of a small claims filing would not make it worth it.

OP - I think you're getting screwed. Hopefully you can get your money back.

I appreciate that you shouldn't have to check your burger or tires. In fact, that's when you know when your burger order is screwed up - you have to bite into it. But I join the camp that as for shoes or clothes, I always check the size. Even if I buy from Nordstrom's, try them on and get home, I check the size to make sure the sales associate didn't screw up and somehow mis-match shoe sizes. Even more so with eBay purchases (I hate ebay). But I also realize folks just don't do that. The only issue now is what has been raised, arguing for a full refund. Of course you think you should get it. Seller doesn't. Let's see what paypal or your credit card company says.
