Child support is similar to student loans.

It cannot be discharged in a bankruptcy. Sure, someone can try to dodge payments indefinitely or live on a cash basis and claim poverty ( while risking jail time for non payment ) but generally it will bite you ********** at one point.

Unpaid child support will also cost you your drivers license and passport.
At least in my state.

Yeah, it's brutal.

Here in Texas, I think they can do that too.

But it's a catch 22.

The family court judges here generally know that if they jail someone or even take their drivers license away then there's little chance that the child support will ever be paid. But if they sense that someone is avoiding payment by fraud ( living on a cash income basis ) or just refuses to pay, they often do put someone in jail.

Not for years I think. But for something like 3-6 months which will get someone's attention.

I don't know if it's been brought up yet. But here in Harris County, Texas if someone is a wage earner ( an employee who gets a W-2 ) then the court will automatically deduct the money from the pay of the spouse who has been ordered to pay and disburse the money to the custodial spouse. And I have heard of Fathers being awarded custody of a child and then getting court ordered child support from the Mom.

I think this has been brought up. If the girl in the OP is really wacky, then the father would have a chance for custodial custody. If he gets it, he would have no child support and could even go after her for some. But it's a huge responsibility and would seem to go against his professed feelings of not wanting to be a part of the babies life in any way.

I've even heard of cases where the birth father has avoided child support by relinquishing any and all parental rights. The mother was a dancer-stripper and the father was a married man. He threatened her that he would go for custodial parental rights if she insisted on child support.

It was pretty obvious that he didn't want custody but that the court would award it to him if he tried for it. The mother was a stripper and had a drug problem! But she did want custody of the child so she agreed to relinquish any claim to child support when he gave up all parental rights.

I just realized that you were not from the US. A judge would definitely NOT say that! Remember, the man was not "tricked" into it. He was stupid and didn't wear a condom. Can you hold a woman liable if she says, "I'm disease free" and you go in raw and get AIDS or herpes. Part of that is your(his) stupidity. Young people do stupid things(I know, I was there there) and now he will have to pay the price and raise a child that it looks like he didn't want!

Just the opposite, unfortunately. Most judges and juries would force the guy to pay under any circumstances. When it comes to rulings over child-related matters, divorce, and other he-said/she-said issues, the justice system nearly always rules in favor of the woman. Heck, there was even an (in)famous case a few years back in which a guy got a ** from a girl, and she secretly spat his ***** into a plastic cup, froze it, then later thawed it back out and successfully impregnated herself with it. The court ruled that the man had given her the ***** as a "gift" when he came in her mouth, and that it was legally her "property" to do with as she pleased. So he ended up paying child support.

Thanks everyone for all the replies. I talked to my friend. He has now "accepted his fate and is going to make the best of the situation" and do the right thing by raising the kid.

She is still maintaining that she did receive the birth control shot and was completely shocked to find out she was pregnant. At one point he told her that he knew she didn't receive it and thought she did it on purpose and she threw up.

In CA, itis irrevelent whether or not she said she used birth control or not. They just wanna know if he's the father. Courts hate for one of them to end up on welfare.
