Which fits me better?

Two identical jackets, one 38s and the other 40s. Which do you think fits better, and what alterations are needed?

The first two pics show a jacket which is way too tight around the waist. The two pics on the right show a fairly nice fit. The question is: You tried it on and had to feel that the first jacket is too tight, it's quite extreme. So why did you ask?

I ordered them from Gilt, so couldn't try them on in advance. I agree that the 40 fits better (just wanted confirmation), so I'll be sending the 38 back.

38 appears to fit far too tightly in the back and since both seem to fit your shoulders well I think you are better off going with the 40 and altering accordingly.

I'd say the 40. the back is too obviously scrunching in the 38..
