wearing vests with jeans is that a crime?

i ve always wanted to wear vest but i am not sure on how to rock on it i am afraid it might make me look like a waiter if worn with wrong combination of pants and shirts i ve never thought of this before wearing vests with jeans but i think its quite brilliant after I saw this picture

does it work because the vest is in velvet? or because of the jeans combination?
