Strange Ebay Experience

A few months ago I bought a Kiton Jacket on Ebay

for about 400 Euros.

When it arrived I noticed that the seller did not measure the sleeve length correctly (sleeves are 1-2 cm shorter than advertised). In addition one botton on the sleeve was broken. I also had the impression that the jacked was worn more often than the "once during a fashion show" mentioned.
So I sent an email to him via Ebay and asked what his opinion was about the sleeve lenght and the botton - no response. A week later I sent the same email via PayPal - no response. Then I filed a complaint at PayPal and some time later I was refunded the money because the seller did not respond to them either.
During this time the seller was, and still is, selling other items.

So now I have the jacket and the money.
Isn't that a rather strange behaviour of the seller? Do I legally own the jacket now?

in the case you file an item significantly not as described with paypal, the money is taken by paypal out of the sellers account forced, not by the seller voluntarily refunding the money. but in that dispute the buyer has the responsibility to return the merchandise with delivery confirmation back to the seller.
but in the case of paypal, there are so many incompetent reps working there with a high turnover, not all of them process the disputes correctly and may have forgotten to warn you to return the jacket.

anyways, the seller will notice his money gone , and realistically you may be hearing back from paypal later or the seller demanding you return the merchandise.

no matter what , you should know the right thing to do anyways, sensibly , anyone knows the money refunded , you should return the merchandise, whether they say or not.

If you send it back, make you sure you get some type of delivery confirmation to prove it was sent back.

After selling on Ebay for a while and dealing with paypal, I can only say that I can't wait until other online auctions come along and put them out of business. They are completely terrible. (and I do have a 100% feedback rating) Ebay's and Paypal's help are worthless if you get help at all. I got the best help in the Community section of Ebay (and I got it very quickly). Maybe this would help? I just posted my problem(s) and other experienced members got back to me within an hour offering suggestions and had the solution to what problems I was having at the time. It is very similar to a forum (like Styleforum) as you just post and others respond.

If you found someone's wallet filled with cash while in a casino, would you decide to keep it because you've repeatedly lost money gambling there?

I can't wait until you decide to list stuff on eBay.

Return the jacket, it's the right thing to do. And make sure the package is trackable and to retain the tracking number.

I would suggest you hold the item and contact him again about how to return it. It could be that the seller has moved or has some other issues and may not be able to get the item where you ship it.

The issue is , if you mail it back , you essentially lose the cost of shipping, even though it was not your fault in measurement.

i would contact him 3 more times over the course of 2 months and ask for a return shipping label. If they do not respond , I would donate it.

I'll try to get in contact with him again, although I doubt he will respond. If he was still interested in his jacked all he'd have to do is answer one of my previous mails, where I offered him to send it back for a refund... Strangely, earlier, after I sent the payment and asked him if he has shipped, he reponded quickly.

It's likely he has very little invested in the garment, and at this point views dealing with it as more trouble than it's worth.

I think you should make a good faith effort(s) to contact him in order to return it (as suggested above), but if he continually refuses to respond then I think there comes a point when you can in good conscience keep it.

I think of the problem like this, he described the item so purly that you should keep the jacket if it isn't too small that is.
