why does he have the pentagon flag? Isn't that a property of government?

It was being flown by a construction company off one of their cranes while they were doing work on the Pentagon. The flag did not belong to the Pentagon.

Did anyone actually read anything involved with this auction?

Yes, actually sad, and I suspect that both issues are contributing to the high price.

I am surprised not to have heard anything in the local news outlets about this sale.

Interesting news: I guess you had better be sure that its the real thing when buying a 70 dollar USA flag. Its not like its Faux pearls or anything like that.

RICHMOND, VA. "” An American flag reportedly flown at the Pentagon during the Sept. 11 terrorist attacks is up for sale again after the high bidder withdrew his offer.

Todd Schimmel, 26, of Mound, Minn., took back his $371,300 (U.S.) bid Tuesday after doubt was raised about whether the flag had really been flying during the attack.

Mr. Schimmel did not return phone calls from The Associated Press on Tuesday. A request for comment e-mailed to the eBay account of the high bidder brought a brief response: "Flag is a fake Im not accepting."

David Nicholson, 44, of Orange, Va., auctioned the flag on eBay to raise money for his kidney cancer treatment.

The flag reportedly flew over a construction crane at the Pentagon. But during the original auction, Md.-based Facchina Construction Co., which gave Nicholson the flag, said it did not have a crane at the Pentagon on Sept. 11, 2001.

An update on the controversy is included in the description for the new, three-day auction, which was started on eBay Tuesday evening. The description also includes the text of a letter of authenticity Mr. Nicholson said is signed by a Facchina site supervisor.

"Everything happens for a reason, and it will all work out for the best," Mr. Nicholson said.

was sent by our attorney to Michael Jacobson, Esq., Senior Vice President and General Counsel of eBay Inc. Dear Mr. Jacobson: This firm represents Facchina Construction Company ("Facchina"). The purpose of this letter is to advise eBay of a potential problem with an item for sale on eBay. On March 4, 2005, David Nicholson (eBay Seller Identification "rounder 23") posted Item No. 3962513751 for sale on eBay. The item description indicates that Mr. Nicholson is selling an American flag that purportedly hung on a Facchina crane located at the Pentagon on September 11, 2001. The item description states that the flag is accompanied by a Certificate of Authenticity from Facchina. Please be advised that the item description is erroneous. Facchina has advised us that it did not have a crane on site at the Pentagon on September 11, 2001. Therefore, the flag being sold by Mr. Nicholson was not hanging on Facchina's crane at the Pentagon on September 11, 2001. Further, Facchina has never seen the Certificate of authenticity that purportedly was given to Mr. Nicholson. Facchina did not issue a Certificate of Authenticity for the flag. To the extent that such a Certificate exists, the issuance of the Certificate was not authorized by Facchina. Facchina does not and cannot certify that the flag was hanging at the Pentagon on September 11, 2001. Facchina requests that eBay take appropriate action to address this matter. At a minimum, Facchina requests that eBay correct the item description and advise any bidders on the item that the Facchina Certificate of Authenticity is unauthorized and invalid.
