My prediction is that for 2021 they fine Max 5 points and RBR some number of points where they still keep 2nd in the constructors.

And a bigger fine in 2022 that doesn’t affect the outcome of either championship either.

Personally I’m happy to let the team escape any punishment in ‘21 or ‘22 as long as they make Helmut Marko **** a pig on YouTube

They won't deduct '21 points because it would make Lewis champion. Given that, they should reduce RBR's allowed wind tunnel and CFD time and deduct the overage from their '22/'23 budget cap.

FIA probably delaying because RB had a major breach and they don't want to revoke Max's title. They're using this extra time to try to figure out a way to squeeze RB under the cap.

Why don't they just revoke the constructions championship $winnings$ (not the points or results) and hand it to the teams in compliance. That's a ton of $ they'd be subsidizing to their competitors plus massive reputational damage to Red Bull and its sponsors.

Because large teams can easily absorb the loss of money. If the FIA doesn't want to revoke past championships, then the best thing to do is dock prize money, reduce current and future cap spend, and reduce current and fture CFD/wind tunnel time. The consequences have to be more than just less prize money.

What good is a major regulation like budget caps if there aren't serious consequences? The teams have accountants who should be able to keep them under budget. The whole point of caps is to level the playing field so one team/driver doesn't have an advantage. When RBR exceeds the cap and Max wins last year (and likely this year), it's not possible to say that they weren't at an advantage.

My guess is that any material cap violations will be the result of an optimistic/overly clever interpretation of the financial restrictions. The accounts that the teams submit to the FIA will almost certainly show the teams to be in compliance, and only in the auditing will the difference in interpretations reveal the overspend.

It's claimed RBR face a small £22,000 fine for a very minor overspend of £131,000 well within the 5% rule (due to some kind of disagreement with the FIA about staff pay) and no further sanctions or points deductions will be imposed.

Where this leaves Aston Martin (a Mercedes-Benz customer) is not known as yet, but the rumour is one team has overspent significantly.
