I don't think anyone has ever argued that black shoes cannot be worn during the day. Traditionally, brown shoes are not appropriate at night (i.e. only black shoes at night). However, I, personally, have worn brown shoes at night, and nothing bad has happened to me (honest).
As for black pants, they appear to be a source of great passion and distress for many, so I will refrain from stating my opinion.
