Advice on Ebay dispute

Has anyone ever had a dispute with a buyer on Ebay and gone through the "court" process?

I sold a guy a pair of Incotex for Zegna wool pants that have the telltale tags/details, but none of which actually say Zegna or Incotex. I am 100% positive they are Incotex for Zegna.

The buyer is trying to claim the pants are fake, since there are no tags with the words Incotex or Zegna, and he should get full refund plus shipping covered. I sent him pictures of several Ebay and SF listings which clearly show the exact same tags in other Inco for Zegna pants and he still claims they are fake. Basically I think he is using this as an excuse to try and return something he's having second thoughts on.

I know the easy thing is just to pay him off and move on, but on principal I'm inclined to let him take me to Ebay court and see what they decide.

Has anyone had any experience with this sort of thing? Does Ebay have a bias towards buyers/sellers and are the people even remotely qualified to understand the fine art of tag reading??

I've never had an eBay dispute personally, but from what I've read on SF this isn't likely to turn out well for you. Sorry.

P.S. Why not sell those pants on SF? There should be a good market for those on B&S - I'm always on the lookout for pairs in a 32-34W, flat front or single pleats.

Did you make this 100% clear? eBay isn't SF. Assume the buyer knows nothing.

You don't have a leg to stand on. Offer him the refund. Either that or subtly remind him that you know where he lives.

I've never had an eBay dispute but have had paypal disputes resolved in my favor (I was the seller). I found the process to be fair and rational and it was resolved within 72 hours, at which point the funds were released. But of course eBay might be completely different - it sounds like the feelings here is that its heavily biased toward the buyer.

I'd be curious to see the actual listing. Did you disclose the tags were cut out?

For example, one of your ended listings, I believe:

If these have all tags intact, great, but if I purchased them and then received them with the tags cut, I'd be ticked off too. No, it doesn't make them fake, of course, but it's something that really needs to be disclosed.

If you didn't disclose that there were no tags indicating that the pants were what you claim them to be, then Ebay/Paypal will side with the buyer. Quite frankly, you're clearly at fault here

I agree with the others -- you do not want to test your luck. You billed it as an Incotex for Zegna pair of pants but there are no labels to corroborate that.

I don't understand. Did the pants have NO tags inside at all?? I had a few pairs of Incotex recently, no INCOTEX label. However, they said "Made For Incotex" on the fabric label and Zegna on the buttons, my assumption, Zegna for Incotex!!

Did the pairs of pants the OP sold have NO tags at all???

I had a similar issue once one a pair of jeans. I was very polite with the buyer and told him where I purchased the jeans and gave him the number of the store. He called to confirm himself and then was apologetic for the accusation.

With eBay, if you have a difficult buyer it's honestly much easier to swallow your pride and have them return it than to try and argue about how you're right. Offer him the info he needs to verify the source, if he still isn't happy, then happily refund upon return.
