, but if Macy's gets and can resell the merchandise (i.e, as long as it's not damaged or really, really old, etc.), I can see very meritorious arguments that this is not shady. For example: How is it any different from returning a Christmas gift? The return right runs with the garment, not the purchaser. And Macy's is protected: THEY'VE GOT THE MERCHANDISE. This is the same objection I have with people saying foreclosure/short sale is a "moral" issue -- the transaction was structured to protect the bank by way of a securitized asset (THE HOUSE) and they get exactly that protection -- THEY GET THE HOUSE.
