did anyone size up on this? i am considering the 40R, but am regularly a 38R. I noticed the shoulder dimensions in the 40 though (based on an ebay listing) seemed more in line with a 38R. anyone have any experience?

Every RLPL jacket I've tried on fits a size small, so I'd go for it if I were you.

I'm a 6ft 40R, the chest might work for me if I was to go for that ultra fitted look, but the shoulders are way too small. The shoulders are more in line with a typical 38R while the chest may be slightly bigger. So if you are a 38R with some pecs, go for it =).
