And it was dismissed on political question grounds and thus essentially not permitted in US courts. Its a terrible example unless you're trying to argue it should not be permitted in court.

Well Turkey actually shot down Russian plane and not much happened in the way of military response. Russia is very reluctant to engage NATO militarily. This might be why Clinton now is all in your face about confronting Russia in Syria and even hinting at using Hague kangaroo court to aid her threats.
