You should not have been charged. The policy is the so-called bottomless cup - you bought the cup. It's the same as the restaurant having a policy for free soda refills, but charging you for switching to Sprite from Coke midway through lunch. Proper response: "Would you like another capuccino? No? How about regular coffee".
Would a refill of cappuccino be free?If not, then you should pay the $2 without thinking about it. If cappuccino refills are free then maybe you have a point.
Either way, she has the right to charge you if she wants, they are different drinks on the menu. Would you have expected to be able to get a coke refill in your coffee cup for free? They would have also probably taken it off your bill if you mentioned it, asking is also within your rights. If you would rather not do either (pay $2, nor have to complain about it) then your best option is to go somewhere else where they will do this for you.
But to continue to go there, continue to get charged $2, continue to never mention it and continue to get furious or annoyed, that sounds like an utter complete waste of time.
