In the days of my disgusting youth, I worked for an insurance company in their motor department for a bit. Now I don't know if it's handled that differently in the US, but you'll probably want to provide that police report number to the insurance company and you'll really want to try and get that old dudes details if you can. He should be able to provide some sort of witness statement which you can give to the insurance company. Also, where was the damage to your car? Depending on the points of impact, scraping (length and angle), and whatever else it can be determined who was at fault. If you've got side damage and he has frontal, he's fucked imo. The most likely scenario for that to occur is for him to have run the light when you had already entered the intersection. Argue this point with the insurance company. They can be lazy F***ers.

Nahneun's right though. Your premiums are going up regardless.

unfortunately, this is the worst possible situation for you. there's a good chance you will be considered at fault because of this. you REALLY should have gotten any and all bystander information to support your case.

yeah you're probably screwed. I had someone pull into my lane with 2 feet between our cars and slam on his breaks about 15 ft from a red light and I couldn't swerve into another lane because they were all full. I had witnesses and still was considered at fault. sorry man :(

That's insane. Yeah I figure. The police officers report week be up in supposedly 3 to 5 days so that will probably beer the deciding factor. When I asked him about fault he seemed to reinforce that it would be the other driver but know really know

Thanks for the support though. I'm actually on my way to Kentucky for an interview and this is really psyching me out

Accidents suck, but you are alive. Focus on the interview and the car situation will sort itself out. Assuming you have an otherwise clean record, even if you are at fault, the consequences of making a claim will not be earth shattering. Fwiw, Ive been in many, some my fault, others not. Its more of a PIA than anything else as long as you are not badly injured.

next time i'm in an auto accident, i'll be sure to have a bystander take a waywt pic in front of the wreckage. that way i can claim to have the first and only car crash waywt in this thread
