This is the sort of tripe we can expect from the masses of ignorant keyboard lawyers:

"I say Obama should not leave office or allow an election until the SCOTUS complete again. It's the basis of our country. Efff the GOP!"

Where to even start . . .

If I were the GOP leadership I'd trade the nomination for indicting Hillary.

The GOP just have to be adults about this. There's plenty of time for a nomination, thorough vetting, and getting that woman (or possibly a man of colour) appointed. The calls by the GOP to let the next POTUS do the appointment are rather lame.

Pretty sure that qualifies as a POC, no? Also, you really think he's going to appoint a white guy? Only chance of that happening would be if he was openly gay or a trans-man.

Well with Bernie coming on strong she might make the perfect sacrificial lamb . They could indict her till the cows come home . The partisan types could vent all their hatred and bile.Since she's not really guilty of any kind of punishable crime all Hills would have to do is sit tight roll her eyes ,wait for the indignant hypocritical posturing to subside ,walk away and make millions on books and lectures.Yet another epic fail by the GOP to "punish" those who they disagree with is placed in the history books

How is she not guilty of anything (besides the obvious she's in the law maker class not law follower class)? She mishandled classified information. You were in the army, right? If you or I had done what she did while in the army, we would be in Ft Leavenworth.

I didn't say she wasn't  guilty of anything . I said she wasn't guilty of any kind of punishable offense. Both sides of the aisle commit offenses of this scale on a daily basis and have done so for as long as I can remember. No one is going to open that Pandoras box . This is all just hypocritical political posturing. In the long run these things have always backfired on the prosecutors and left them standing looking like the latest incarnation of the Spanish Inquisition

The reality is that situation where the NBC issue comes up will influence the decision/vote counting. If it comes up in the McCain scenario, its going to be 9-0, 8-1 at best, that McCain is a NBC because Military people and their children are just going to get that call every time. If 2 US citizen marry, go overseas for US military service, and have a child in the military base (and then that child then goes into military service and is an injured POW, etc) I just don't see a judge saying that children of military servicepeople born overseas due to military service are not NBCs.

Since Cruz's parents are not military, he's not getting that military respect benefit in his case. Since he is apparently an asshole and possibly pissed off god knows how many scotus clerks and other scotus hanger ons, a ruling that says he's not an NBC is possible.
I haven't followed this stuff closely, and it's not like jurists' views on the substantive merits or on someone's assholery have never colored analyses of standing or justiciability, but how would you envision such a (possible) ruling coming about? Who would have standing to present a justiciable case?

Well that's the truth, which is the essence of my comment about the law maker class.

Reich says the GOP is dead. Any truth to his thoughts?

Isn't this where you muse?

Personally, I don't buy it.  People were saying the same thing about the Dems in 2010.  Regardless of whether the Republicans win in 2016, they will all fall in line behind the nominee in a few short months.  If the nominee wins, they'll all stand behind executive power to do whatever they want.  If they lose, they'll turn to bickering about who caused it.

Also, aren't there plenty of those on both sides of the aisle?

I think he's wrong at the death knell was last election cycle. The support Mitch received was laughable. I think there's something to the thought that any candidate that's acceptable to various powerful factions of the GOP base would not be acceptable to the general voting public and vice versa. Mitch, of course, would be the vice versa example we just had.

I'm going to go out on a limb here and speculate that Reich's intent here may not have been strictly limited to objective, dispassionate analysis.
