Bush v Gore doesn't really present this issue in the way we're discussing, and in any event was such an extraordinary case circumstantially that I think it would have to be treated as an outlier no matter what thread of jurisprudence is being discussed.

And I'm sure what you're saying is true to some extent. Constitutional law is so full of extraconstitutional absurdities that it'd be nearly impossible to be completely consistent, especially when the court is closely divided and the liberal half loves to make up new rules but hates to apply them fairly when they disagree with the result.
Aside from the conclusory conspiracy theory bit at the end I think this is a fair observation.

It costs about $18k per year to keep someone incarcerated in a Florida prison. So if the guy gets 15 years (which he may not) that's $270k to incarcerate a beach fucker. Then, when he gets out he'll be unemployable as a sex offender so he'll go on welfare for the next 20 years. I don't know the cost to supervise a sex offender in Ef El A, but in Pee Ee En En it's about $8k a year. So that's another $160k in taxpayer money. Assuming he doesn't commit suicide first.

So the taxpayers will pony up at least $430 thousand dollars (not including welfare benefits, food stamps, medicare, etc) to punish some douche bag who fucked on a beach.

Great job, guys. Great job.

He's not just a beach fucker. He's a shithead who screws in front of children on a beach then menaces their parents when they complain. And he also happened to be a drug dealer out on an early release, so back he goes. I don't feel to bad for him.

Per the article I read, there is no evidence that they were banging in front of a little kids. Their defense seems lame, and they probably were; however, the kid that reported it didn't see anything per the article.

I don't give a shit about him, it's the $430,000.00 that has to paid for him to be punished that I give a shit about. Shithead drug dealers should who screw in front of children should not be so expensive.
