Unless the store tag is still intact, the jacket is only new without tag at best. A lot of people don't remove the sleeve label at first wearing simply because they don't know better. Same with the pockets sewn shut deal.
If the sleeves are unfinished and basting thread are still intact, you might have a case. Even then, it probably still new without
tag (the key word, really).
