WTF over-zealous police? - Page 205

It's game day here, so I get they're trolling for DUIs, but lame sonuvabitch. Pulled me over and did the, "Do you know why I pulled you over?" As, for a change, I was doing exactly nothing wrong I told him I didn't have the foggiest idea. He said he "didn't like" the lane change I just made. I told him I know I signaled, and as my car is equipped with lane change sensors, there is not a chance I did not have a safe amount of room to change lanes. That's when he told me to take my sunglasses off while we were talking. Asshole of course had shades on himself and didn't think about taking his off.

He asked you to take them off so he could verify your identity and make sure you were safe to drive. Taking his glasses off doesn't advance either of those goals.

I realize he wanted to see my eyes so he could say they were bloodshot and/or glassy whether they were or not. Knew I should have stayed away from that area of town today.

The field sobriety are not "real" tests. They're just bullshit that was dreamed up to create the PC to give you the breath or blood test. I think you can refuse them in most, maybe all, states period, end of story.

He wanted to see the color of your eyes, and get a better look at your face to see if you matched your license. Some Cops are more anal aout that kind of stuff. Glad you didn't go to the pokey. satisfied.gif

Oh bullshit. He wanted to make a DUI arrest, period. The cop doesn't need to see your eye colour (which half the time is wrong on licenses anyway) to see your identity. No need to take your glasses off just because a cop asks you to.

Piob, did he issue you any kind of ticket? Just some bullshit warning? What was the end result?

After he threatened me with a road side sobriety test if I didn't remove my sunglasses, both of which I politely refused, I asked him if I was being detained and was I free to go. He didn't say anything and was looking at my license. I again politely asked him if I was being detained and could I have my license and insurance card back and go if I wasn't? He handed me my stuff back, didn't say anything and just looked at me again for about a minute, so now that I had my stuff I asked him again if I was free to go. He told me to "watch my driving" and not make "aggressive lane changes" in the future, which I thought was hilarious given my lane change was fine and the asshole manner most cops drive in, and told me to have a good night and he walked away, got in his cruiser and zoomed out of there in a most aggressive fashion.

Interesting to note he never asked me if I had been drinking. Went right to threats of a road side sobriety when I would not remove my sunglasses. I had had a couple glasses of wine but it really was just a couple of glasses and over a couple of hours.

lol he hammers it outta there to show he has retained his power irregardless of his sunglass defeat. Sweet.

Are you in a 0.05 BAC forced-cab-home 24hr suspension jurisdiction such as up here in the nanny state or is 0.08 the only number to worry about?

I didn't say you had to take your sunglasses off if the cop asked you to. But if he gives you an actual order to do it, you're on shaky ground at best if you refuse.

When someone says to take your glasses off while he's talking to you that's not what I'd call a "lawful order." Seems to me he was just doing the prick cop power thing and we all know he was attempting to gather or manufacture PC. He failed right off the bat with the lane change thing, given my explanation and the fact my wife was a witness to my signaling, and was just trying to fuck with my head and rattle my chain. Once he failed with the lane change is when he started asking me to take off my sunglasses. When he escalated right to threats of a roadside sobriety, and would not answer my question of if I was being detained or not, I figured if I continued to be polite and firm I would be on my way in a couple of minutes. I'm glad he didn't ask me if I had been drinking though as I'm sure my refusal to answer that question might have made the prick get me to blow.

SR, .08 in my state but there's something about if a cop thinks you're impaired even under that you can get in trouble. There's no way I would have blown more than about .02-.03 but I was not taking my chances with this prick unless he actually made me blow. Not a chance I was going to let him roadside me to say that even though my BA was legal I was showing physical signs of being impaired, as in his judgement, I failed some or all of the field.

FWIW I've practiced the balance on one foot and the walk the line and pivot/turn. I can do both flawlessly when I'm totally shit faced. smile.gif
