It looks like the refund process did go through. I accepted your return, and will refund you $15 (rounded up from $14.36) per my business policies, as soon as the shoes arrive.

Well, they are clearly marked as size 11. Make sure one of your responses to the buyer includes stating that the size is shown on the sole. Of course, that could still be a UK 11....

 

 

I'd tell him that returns must be handled through the proper channel (through Ebay). Unfortunately, since you offer returns, Ebay will automatically side with the buyer unless you can document that his reason for a SNAD case is bogus (tough, but doable in this case).

 

I might also suggest calling and talking to an Ebay CSR.

I'm not convinced that this particular Ebay rep knew what she was talking about, but she said there was nothing to remove, and that the Trademark violation was due to not being allowed to use Dolce & Gabbana in the title of my listing.  I asked her how I'm supposed to sell such a shirt, if I can't refer to it as such.  And I also mentioned that I thought the "trademark violation" email they sent me, mentioned it was because they thought it was counterfeit, and wondered why they thought as such.  I also mentioned, that the shirt is gone, and now in the hands of the buyer, who left me positive feedback.

 

She said there is nothing to remove from my account, but if I want to list anything else using Dolce & Gabbana I would have to email their trademark email address first (apparently, it is referenced in the email they sent me).

I may call again.  I don't know.  Now I'm worried, if I find any Dolce & Gabbana stuff, I may run into issues?  I'm going to re-read the email they sent me, but it's pretty vague.  Basically just states, they were asked to remove my listing.

Some brands are weird about this shit... I once tried to sell a Cardo Bluetooth Headset, and got Vero'd. It turned out they didn't want me offering international shipping; but they never said that in the communication through Ebay. I had to play guessing games and even sent emails directly to Cardo. I sold another one a few months ago with absolutely no issues.

If Vero removed your listing, the rights holder didnt want you selling it for some reason. But if the listing closed, its a moot point and should be removed. A Vero violation stays on your account for 1 year, and if you get more than one, they can restrict your listings/account. So I would have them confirm that there is no violation on your account, and if there is one, have them remove it because it came in post-auction.

The eBay trademark violation takedowns are often bullshit in any case, I got one for a guitar I was selling that is styled like a Rickenbacker model. Rickenbacker are really heavy handed about protecting their trademarks - to the extent that it damages their reputation, they come across like arseholes and people refuse to buy their instruments.

In any case, my point is, the trademark violation wasn't relevant in the UK, but eBay took my auction down anyway. They seem to be scared of being sued.

Any help with what "name" jackets/vests these are? Anywhere to check reference numbers on the tags? Also tagged size 3 but almost fit me (size small) and I thought 3 was "US LARGE"

Believe me, I know the reasons and it's still bullshit. Rickenbacker are bit players now, and the irony is, the people brought up on cheap Strat and Les Paul copies in the 80s are often the ones buying custom shop Fenders and Gibsons now, so who was harmed by the copies...

Anyway, that's off topic enough for the evening - on the subject of the Timberland boots, if you are sure they are a U.S. 11 I'd be tempted to play hardball, if there is a chance that's a UK size, you may have to come to a compromise. FWIW, I have Timberland boots, bought in the UK and they have US and UK sizes so if be very surprised if that was a UK size.
