What should I do in this situation?

Three weeks ago my girlfriend and I found a new apartment. We signed the lease, I paid the deposit (which the landowner cashed) and thought everything was all set for a move in June 1st. I call her yesterday to ask when the current tenants are moving out, to see if we can start moving in early, and she calls me back and tells me there's a huge horrible mix up and she's sorry but they're not leaving until July 1st, and that in the mean time she can put us up in an apartment in the next house over (she owns three houses in a row), that's the same size, until our apartment is vacated. She also offered to pay the utilities for the month.

My issue is this: this is a huge fucking pain in the ass and I want more than my $75 utility bill paid -- I want something off the rent. I called her today and mentioned this, and she was really hesitant and was like "I'll call you back tonight after I talk to the current tentants and get a firm move-out date," and I'm wondering how hard I should push. This woman is going to be our landlord for the next 14 months, and while we're good tenants, we do have a dog that can sometimes bark. Should I take a hardline or let this one go for the sake of maintaining a good relationship?

I'd move into the other apartment and ask for 25% off your first month's rent.

The real annoyance is the movement of your goods between places.. fuck that'd be frustrating.

Why not take the apartment that is available June 1st permanently rather than the one that you originally agreed to?

This seems like the best alternative. Is the other place not as nice or something?


$75 for the hassle of having to live in a temporary place for a month and then move all your stuff over again is pretty bad. I got half my first month's rent off one time because the place was two days late getting ready.

the june 1st apartment is carpeted and we have a dog. so no go on that.

Ask her to pay your moving expenses for when you move the second time.

I'll give you my thoughts (as a landlord)

She has no control over when the tenants move out. I'll guess that your lease has a provision that the landlord is supposed to be notified 30 or 60 days in advance of an intended move out in the event that the lease is not renewed. With that being said, they can still stay in, as long as they are paying the rent and following the rules. What she should have done was structure your lease so that it allowed for provisions in the event that the unit was not vacated.

With that being said (and IANAL), it seems as though you may be able to cancel the lease, if you wanted. You should also consider a new lease agreement changing the dates as appropriate.

Utility payment is not enough - 50% off first month is fair.
