had a pfa in place

shot at him, but did not hit him, did not injure him

it was a warning shot into the wall

she was not allowed to invole stand your ground by the judge

20 years, no parole, minimum, they offered her 3 with a chance of parole and time off for good behavior, might do 2 or so

Shoot and wound someone, and it's 25 years to life.

 

in the zimmerman case the judge can disallow the stand your ground defense if he feels zimmerman could have avoided the sitution

by staying in his car

retreating

not chasing the kid

he was not cornered or surprised, he initiated the confrontation...just wait 2 minutes for cops

instead he chased the kid on foot with a gun

 

this is what will happen, the stand your ground will be tossed and he will get 25 to life if no plea

and zimmerman could have not initiated the contact by staying put and not chasing him

 

from what I understand

pre-trial hearing by the judge, if he decides syg applies, case over, dismissed

if not, 2 scenarios

he disallows the use of the syg as a defense, zimmerman is screwed

he allows it as a defense and the jury decides, with the knowledge the judge did not allow it and did not dismiss the case

Not exactly. Stand your ground is an immunity to prosecution, so the judge dismisses the case if he finds that it applies. If the judge decides that he hasn't met his burden, all of his defenses are still available to him in front of the jury.

The part of the law that has come to be referred to as "stand your ground" (for some reason) is the immunity to prosecution. That is decided by the judge prior to trial. The judge decides if he is immune from prosecution. If the judge finds that he is not, he can still make a self defense claim based on the law and the evidence. The judge has no power to "disallow" him a defense to which he is entitled.
