Tagut - I disagree slightly with your description of the popular view of Agnosticism. I'd describe it more as "theistic secularism" - whether it's the "Capital G" as you refer that they refute is incidental (meaning I read your statement as saying they may believe in some polytheistic universe). I think most American agnostics tend toward monotheism with a serious doubt that any organized religion has anything at all to do with that single deity.

I also think the "Atheism as Religion" thing is probably not as broad as people think, but those people are the voice of Atheism, so it's easy for the popular perception to be swayed.

I thought that at first, but people like Scotusblog seem to think that the standing issue isn't getting a lot of traction from the Court. It would be like them to punt like that, though.

Why would the case lack standing? Based off of Wikipedia, claimants would have been injured due to having protections removed, etc.

The defense wouldn't have standing. The governor and AG both declined to defend and it's some private org that is defending.

Basically, if the Court did this, the law would be overturned in California, but it would have no precedential value on the federal level.

What's the point of having a state constitution if it can be defeated by the acquiescence of a couple state officials?
