Canadian distributor - Throat Threads distributed 2010/2011 NAPAPIJRI clothing to a local relailor in Thunder Bay, Ontario Canada, advertising it as a 2011/2012 line. The customer payed full price for this jacket, finding out later on that this was last years model. Throat Threads is putting last years NAPAPIJRI product in their catalog for this current season. After contacting Throat Threads the customer was told by the Sales Representative that the reason why they are selling old merchandise is because Canada's fashion is behind European fashion where Napapijri is based. However, This is not a valid excuse to sell outdated merchandise. I am trying to get to the bottom of this as the customers local relailor had no idea he was selling last years Napapijri line either. This could possibly be classified as False Advertising.
Anyone with any information about the legality of this senario would be greatly appreciated.
