Dilemma: Busted Stove in the Apt, what to do?

So, I was having an issue with my stove in my apartment a couple of weeks ago that was causing my fire alarm to go off whenever I would try to use it.

I called my super and she had someone come to take a look. He told me one of the burners on my stove had a problem and needed to be replaced. My super then called me and told me she wasn't comfortable simply replacing the burner and that she would need to have the whole stove replaced. She asked me if I could be home last Monday morning from 9-12 so that they could come and install the new stove since she doesn't have access to my unit. The people at work said this was ok, so I stayed home. I received a phone call from my super at 11:30 saying that they wouldn't be able to make the appointment today and that they could come tomorrow. I said that's fine but that I couldn't be there. I ended up leaving my keys with my super so that she could take care of it.

They brought another (used) stove on Tuesday or Wednesday that didn't work. Then, on Friday, they brought another (used) stove that works, but that has a small gas leak. There is a faint smell when I walk into my apartment after being at work all day, which gets much strong if I go near the stove top. My guess is that one of the valves on the stove doesn't close all the way or something similar.

In any case, my super now wants me to be there for them to work on this stove again. This is the 3rd time I will be dealing with this. I can't keep ducking out of work, and due to the nature of my work, I do not have a regular 9-5 schedule. Should I just get a new stove and deduct that from the rent or will I get in trouble for doing so?

It's not your property, so unfortunately you don't really have a choice.

I dont understand why your landlord doesnt have access to your place to make repairs. Annoying, yes, but the Landlord is actively trying to fix the problem. If you went and bought a new stove and tried to deduct it without my permission in advance I would consider it a missed rent payment and start down that road.

Just deal with it, or buy a house.....

Yeah I couldn't imagine the look on my landlord's face if I gave her a rent check for $100 b/c I spent 500 on a new stove. "Uhhh... That's not how it works, you moran."

Ask the super to be there. That's what he's paid for

If need be let your immediate supervisor know you have a gas leak in your house and will need a few hours to deal with that. I don't understand why your landlord can't manage the problem alone... What state are you in? "Repair and deduct" remedies can certainly get the job done.

Except, my rent is multiple times the price of a new stove, not a fraction of it...

For what I pay, if I need service / a new stove, I should get it. If I paid $500/month in rent, I'd buy the new one myself with no expectation of being reimbursed and be happy as a clam. I've been out my stove for a week and a half and now have a gas leak in my apartment. Pretty pathetic response to a very seriously problem if you ask me

I would argue that there is a warranty of habitability which is certainly not being met if you have a gas leak that they are slow to repair

They aren't being slow to repair it. They're trying to fix the problem, with conflicting schedules.

If your rent really is multiples of a new stove, and you have a problem with stuff like this, then it might be time to own.

Dude....leave the keys with you super and have them take care of it. Tell the SUPER what you wrote in this thread. They are paid to do stuff like this....They are just being lazzzzzy!

I wish it were that simple...I haven't had time yet to save up for a down payment, real estate is pretty expensive in NYC, and I don't plan on staying in NYC for too much longer.

tell the super to take care of it. i would not keep taking off work after 3 previous appts!

You need to talk with the super. Ask him if you buy a new stove if you can take it out of the next month's rent. Did he say why they they keep putting in used stoves? To me having a gas leak in your apartment is a huge safety issue. But I agree with everyone else you should be able to leave your key with the super and come home and find that the problem was taken care of.

this is a guess....and i may or may not be right....but a used stove MAY be cheaper than a new one...

Last time I had a gas leak, I found it Sunday morning and the apt owner had it fixed Sunday afternoon. Usually they give a damn about their property not going boom.
