How do I fight a stop sign moving violation? - Page 2

First check the sign, make sure its a valid stop sign.

if it is, then I would get a lawyer, assuming this is your first offense in a while they may make you pay the fee and pardon the points associated with a moving violation. you're insurance company cannot increase your insurance because of the legal ruling, from what I understand based on my own experience.

Usually no matter what the fee is paid although $700 is outrageous and may refer to excess fees that you may be able to avoid, but I would leave that to a lawyer, and a lawyer shouldn't be paid more than $100 to take this case.

Lastly, if you are a gambler, and it looks like your chances are high here, you can avoid paying a lawyer and represent yourself and pray the cop does not show up or that he remembers your "deal"

At the end of the day this can go many ways and I believe in the end you should at least focus on getting the points off your license since once Insurance picks up on it they may increase your payments and that may end up costing you more in the future than the ticket does right now, depending on the figures of course.

Or you can try fighting it.

This is how it is where I live. I had cleaned out my car one time and forgot to put my license/registration packet back in the glove box. I got pulled over for not having a front plate and then got nailed for not having my insurance card with me. All I had to do was show proof at the county office that I was actually insured at the time I was pulled over and the fee was reduced from $1000 to something like 10 bucks. If a person can't prove it, of course (which means he was basically busted without insurance), then the fine is really high--which is how it ought to be, IMHO.

You sure the burden of proof is on him/them? I know laws may change but what a police officer says (to have seen) is eligible as evidence over here. Apologies if this is a well known fact
