tx gone bad - opinion needed

a few weeks ago, I bought a used "Brooks Brothers Golden Fleece suit 44" from a new seller here for $75. it arrived, and while I only gave it a quick once over, I was disappointed in the condition. the interior armpit lining was ripped and it was dirty - needed drycleaning.

the seller agreed to refund me $20 to fix the lining but basically said "eh" to the condition. w/e, I get used clothes dry cleaned when I buy them anyways. so I took the suit to my tailor to get the pants shortened/hemmed and the lining fixed.

I pick up the suit to today, and the tailor says "you know, this isn't a suit - the pants don't match". WTF! I look closely, and he is right of course. the pants - while very close - are not a perfect match. they are also Brooks Brothers, and a very close color and material, but not quit a 100% match.

of course I'm an idiot for not noticing this myself. that's my fault, along with the extra $20 I spent to have the pants shortened and cuffed. but I also shouldn't have been sold a suit that's not a suit (and a damaged one at that).

I haven't talked to him about this yet, b/c I don't know what the most fair solution is. I don't want a mismatched suit, and he probably doesn't want it back, if it was his size anyways, which I'm not sure about. most sellers wouldn't take back a suit after it's been altered anyways, which I understand.

so far I spent $75 on the suit + $20 to get the lining fixed + $20 for the pants to be cuffed. he has agreed to refund me $20 to fix the lining, though that was about 10 days ago and I haven't seen the refund yet.

fortunately this isn't a lot of money we're talking about, and I really don't even care about the money, but being ripped off leaves a bad taste in my mouth, and it's not right that he sold a suit that wasn't a suit. plus it was ripped.

so tell me SF, what is the fair resolution here?

He paypals you the $20 you agreed upon, and while the rest sucks, if you got it altered, you are most likely stuck with it. Split them up and sell separately on eBay and hope to recoup some of your losses.

The pants appear to fit so I would keep them since you got them altered to your specifications. I would sell the jacket for whatever it is worth and just move on from this.

Post his name on the buyer/seller feedback and lets ban him!! No shady ppl please

I'd try contacting him again. He might prove more amenable to some kind of settlement than you think (at least I like to think such nice things about SF sellers/buyers). Quite possibly he bought the suit from a thrift store/consignment and didn't realize himself that it wasn't a suit. Best case scenario is he refunds you the original price, but I don't think you can really expect him to pay for the alterations.

The mismatching might be an honest mistake if no one noticed before the tailor did. And assuming you get your refund, he's at least showing goodwill. I also think that if you're buying a suit for $75 you shouldn't have too high expectations That said, if I sold you what I told you was a suit, and it actually wasn't a suit, I would refund you. But that's just my opinion

Is the fabric the same, just a different shade? It could be because you or him might have drycleaned them separately and they didn't fade the same.
