its pretty cut and dry, you're doing her a favor by not filing a claim or reporting to DMV.

This is the right answer.

You're likely doing HER a favor by letting this get fixed without her ins. co learning that she caused an accident. If she doesn't like that favor you're doing for her, go the "traditional" route of insurance.

File a claim with your insurance company. Tell them the name of the lady who hit you. Your insurance company will cover the claim and then subrogate against her insurance. Your rates will not increase since claims are deemed "chargeable" net of subrogation value (this claim will cost your insurance company 0$ net of subrogation).

I'm not an attorney but I do work in the P&C insurance industry.
