Sorry I didn't word that well… meaning privately and surreptitiously is illegal. I thought it was implied that if one consents then of course it's ok. I just can't believe anyone would be so dumb to consent though and say shit like that. I mean, does he know about the internet?

It has been reported that she has over 100 hrs of recordings. No one(that I have seen) has mentioned her breaking the law re the recording or getting prosecuted. One one of the tapes, maybe she said something along the lines of:
"I am going to record this so that you can hear yourself some day". Maybe his dumb ass said, "Ok". That's consent.

Not like he wasn't nodding to all of her other requests.

Of course I mean I get that... but if unconfirmed after Silver already having taken action and this particular recording is proven to have been obtained illegally (or more appropriately NOT proven to have had consent) that sets a pretty fucked up private thought/speech police type precedent.

Clandestine recording and public disclosure of private fact are both illegal in CA… so what no one's mentioned it. I don't think any of the players is interested in due process and my point is let's reverse the situation and get some players talking shit privately about women, homosexuals, white people whatever and see what happens then.

Pretty much. Damage has been done, regardless of whether it was legally obtain or not. NBA doesn't care about the semantics. Sterling can due his little sex toy if he wants, but the league is going to kick him out for being dumb enough to get caught.

NBA has an owner's "constitution". They can care less when it comes to if it was obtained legally.

He signed and is a part of that constitution which includes a clause re harming the league or other owners.

Also, the current commish has been a part of the NBA for a long time. He said that he based his decision ONLY on this incident. I call BS on that. He has to have known/heard rumors/seen first hand how this idiot acted in the past. Doc Rivers just said that he knew of rumors but never saw first hand.

Commish wanted to let everyone know that he would not look the other way. No need for a month long investigation. No need to hire investigative firms to consult on the matter.

He probably picked up the phone, asked Sterling if it was his voice. And then spoke to the NBA attorneys/some owners/players union and KJ.

I'll take all further Clips comments to the CESS but Reggie Miller just said "now the healing can begin." What fucking healing? How much pain can really be caused by a few B grade racists comments made in private? Terms like that are better reserved for real events, the Boston Bombing, ect, ect.

Agreed Ter that's probably how it went down. Of course I think what Sterling said was reprehensible although not really that explicit let's be honest... I've heard backcountry talk much worse than that. I just saw this on ESPN… these cases could get very interesting.
