A legal contract is a legal contract. The Tom/Kat example, it's quite possible that they did have a 7-figure prenup, but if Tom didn't want to drag it out or have certain things about his religion come out in the press, he may have just wanted to throw money at the problem and get it over with. Same with Tiger. Many times there are escalators (or de-escalators) for the payout in cases of infidelity.

Yeah but that's kinda the point. The prenup becomes meaningless once you achieve all this fame and money. Imagine the headlines (and sponsors) if Kobe gets divorced and she and his kids only get a few million and only one house? The expectation is that once the kids are accustomed to a certain lifestyle, you have to keep funding it even if you get divorced and she is busy getting plowed by Shaquille in the $10 million house you had to buy/give her. The guy will always be made to look like an ass if he is rich and doesn't put up huge for the ex-wife/kids.

Well that's his choice isn't it. He can take the temporary hit to his image and keep more of the money he has already made, or he can take a hit to his finances and try to make it up with more endorsements over the long term.

Kobe have never been a great marketing tool. He does okay, but he gets dwarfed by LeBron, so at this stage in his life he should just keep the money and stick to his prenup. Nobody is going to care in a couple of years anyways. Look at Tiger, it's only been 2.5 years since his meltdown and nobody even seems to remember that he was way bigger scumbag (at least in terms of what we know to be true) than Kobe has ever been.

Actually, Kobe is a marketing God outside of the US. I say he is on the same level as Lebron in the US (which is saying something since he had to rehab his image after the rape charges). But in China, no one is more famous than Kobe, he probably even beats Jordan in popularity there. You have no idea how much money Nike makes off of Kobe in China alone. With Lebron winning a championship (finally) and a gold this year and Kobe on his way out, Lebron is definitely about to take the crown from him, evident by Nike releasing his next sneaker at $315 (this is actually all over the news now) so they really are testing his market. I doubt it'll sell as well as Jordans or the cheaper Kobes/Lebrons but even at 30%-50% off, Nike will bank on that shoe.

Actually, the whole pre-nup as binding contract is not correct. They are very easy to have thrown out and there are very particular steps that need to be taken to make them as iron clad as one would think they are/want them to be, and even then they are not rock solid. Those steps are not commonly taken and I very much doubt Kobe took them.

+1 Anytime there is that large of an estate at risk, there are plenty of billing hours to inspect every small detail of the agreement. There is usually a hole in every contract if you have enough smart people looking for it. . .
