It is interesting that under Condition Report it states all of the following:
Band: Missing one side of the band, other side shows heavy wear.
Case: Moderate surface scratches
Case Back: Case back has moderate scratches.
Dial: The dial shows wear and its age, minor damage overall with damage to the date window.
Crystal: The crystal appears to be in great condition with little to no scratches.
Bezel: The bezel has minor scuffs and scratches.
Clasp: .
Crown: Crown has minor surface scratches.
What is missing from this "report" is any information regarding the movement. That was a huge red flag, along with the failure to show a photo of it, which tells me they knew exactly what they were doing.
A watch like that is either referred to as a "marriage" watch or "Frankenstein." Calling it a Breguet when it does not have a Breguet movement would certainly qualify as "significantly not as described." Omitting the information about the movement would be irrelevant since they identified the watch as a Breguet and for that to be true it would have to have a Breguet movement.
Also, at the very bottom of his auction it states: "100% Authenticity Guaranteed - We will never knowingly sell a replica time piece. Should this happen - we offer a full 100% money back guarantee to protect you as the buyer."
I think a simple complaint with Ebay that the item was significantly not as described and that copyright infringement took place since they advertised it as Breguret when it was a "Frankenstein" watch would have been all you needed to win your case. It is fraud, pure and simple, but great that it all worked out for you.
Now, I wonder if the guy is going to relist the watch?
