eBay issue. Any opinions?

So I sold a tie about a month ago on eBay. The tie had the skinny end cut off for some reason. I bought it from a small shop that sells samples. Anyway, I fully disclosed the length, where it was cut and took a photo of the said flaw. Anyway, I get this message today:

"I got this tie today
because I shipped it to my friend's house and he came to korea today
I can't undestand how could you think that sell it?
You shoud throw it out.
It can't tied on on person's neck
because it's too short.
I have to throw out. Impossible to use
I lost $50.
I think you shoud refund it or give some of reward to me
Or I have to leave negative feedback for my lost $50."


I think to myself "what the hell". I told him I fully disclosed the flaws and even gave him the length measurement. He sent me this reply:

"I mean
you done conscienceless behaviior
and I don't satisfying this transaction
So If you do not give partial refund,I have to leave negative feedbaak

You said it's wearable but it's Impossible to wear."


So, should I just go ahead and let him give me a neg and try to have eBay remove it? I've lost my faith in eBay/Paypal a couple weeks ago when they basically robbed me of $50 because someone claims they never recieved their package when I provided the customs form # that said it was still in transit. Is there even a chance eBay will side with me and remove it or will they side with this scammer?

I'm really getting sick of eBay and their asinine rules. The fact that we can't leave neg. feedback for the buyers just gives the buyers more freedom to scam the sellers.

Yeah, that does suck. Maybe ebay will side with you and remove since it's clearly disclosed in the auction?

Separately, not sure the official policy, but listing an item with such as obvious flaw as NWT doesn't necessarily seem to be the correct classification to me. But since it's not used, there should be some type of "other" or "seconds" condition.

In theory, Paypal only sides with buyers if an item is "significantly not as described."

eBay, however, gives buyers free reign in the feedback department, so if the buyer wants to complain, he can do whatever he wants.

As a side note, if I understand correctly, he had you ship the tie to another person, who then delivered it to him in Korea. If he used his own Paypal account, he might also be able to stiff you on Paypal if the address you shipped to doesn't match the address on the account.

If I remember correctly, whatever address that was on his Paypal was the one I shipped to (it was a US address) because I really don't like shipping to a non-confirmed address and will put up a fight about it (which I've only done a couple times and hasn't been recently).

Its clearly mentioned and photographed, If he didnt read the description its his own fault.

I would let him leave you negative feedback, dont you still get a chance to explain yourself on the feedback page for prospective buyers to read?

Im pretty sure that ebay would side with you, but empty your paypal account and remove your card details before he puts up a dispute!

it's not your fault the buyer doesnt know how to read engrish or is not thorough in reading before buying. i think he is at a loss.

I actually think that your auction is borderline deceptive. A 44 inch tie is completely unwearable, and you know that. You didn't outright lie, and you did disclose the flaw. However, you state that the tie is still wearable even with the cut blade. That is simply false.

Perhaps the buyer should have read more carefully. But while 99% of this forum may know that a 44 inch tie is not wearable, less than 1% of the rest of the world would have any clue what is an appropriate length for a tie.

I'm guessing that you knew the tie was unwearable and were hoping a buyer wouldn't understand that 44 inches made a tie unwearable. If you feel comfortable selling something in this manner, then that's your call. However, I think the buyer has a reasonable complaint.

+1,completely agree with this. I think you should issue partial refund as the seller has a valid concern.You sold a "shitty" tie,you knew it was a "shitty" tie,how can you be comfortable with this?

There is no way in this world ebay would remove a neg for those reasons. I think you should have stated "damaged" or something in the title, so its straight up there, and maybe a full pic of the tie. If the neg means something to you, refund him, cut your stress right there.

Still, he saw it was cut. I provided the measurement. Why didn't he measure a tie of his own to make sure this would work for him?

As stated earlier, most people think that ties are of the same length and therefore wouldn't even think about measuring it. But I was just pulling your leg there.

There's your problem. Your auction says the tie is "very wearable." Your auction listing was wrong, because a 44 inch tie is definitely not "very wearable." I'd classify that as grossly misdescribed, as the item is useless. Your own ignorance about what constitutes a wearable tie is not an excuse.
