Human Resources Question: What searches are done?

Anyone here from Human Resources?

Question: What searches does Human Resources do on a person before they hire them? I had a very unflattering article published about me with my full name blasted all over the place. Should I start taking legal action on the paper or should I not be worried when looking for my next job?

I do hiring and I always google and facebook candidates. If you have an uncommon name and it is easy to identify you from that article then you may find it is a problem.

not from human resources, but my company would have come across that. we do search for criminal record, internet search, credit report

Actually, the article doesn't come up in google when I search for my name. It's a small local town paper, not a major news outlet. Am I safe?

Put your name in quotation marks e.g. "john smith" and then add a keyword that an employer may use...perhaps a city or an industry or something. Does it come up on google?

If not, you may be safe from a simple search.

Was the article un-flattering or actually slanderous? Also a retraction would double the number of times your name comes up in a search, therefore making it more likely to be discovered.

It depends on what position. If you're going to be a key employee, you can figure most companies will do everything from a credit check to a criminal check to some internet searches.

If it's a line position, probably just a criminal check.

Btw, what legal action? I've listened to lawyers enough to know you'd have to prove the paper was factually inaccurate, it was damaging to you, and that the paper had knowledge of the inaccuracy prior to printing. At least, that's how I understand it.

when i google my name and my city it just comes up with my amazon wishlist

i wonder if i haven't gotten jobs cus of stuff on my credit report though...

I'm not sure of the legal action you can take, unless the writer didn't check his sources and it was inaccurate. In Canada the law just changed so that even if all your sources lied to you, as long as you were duly diligent in your research the writer isn't held liable for inaccurate representations of people. I'm not sure what the law is like in your jurisdiction. And then there is always the fact that the truth is the ultimate defence, so if what they published is correct you certainly have no recourse.
