Anyone had an experience w/ eBay seller "4dr.no"???

I recently won a pair of Vass shoes on eBay from seller 4dr.no. Link I won the shoes fair & square though the auction. Clearly he thought they were worth more because he had them listed a few times w/ a higher starting price. After a few listings, he finally started them @ $.99. I won the shoes. Today he emailed me, refunded my money, and told me that they were scratched. He said that he did not feel comfortable selling them to me. I have since requested pictures of the "scratches." The auction photos are highly detailed, and there are no scratches. I feel strongly that he is trying to get out of the auction because he didn't get as much as he wanted. Does anyone have and experience with this guy? I am really pissed because I was looking forward to these shoes. I am prepared to leave negative feedback, but that doesn't resolve my problem. I want the shoes.

I think this is your man. It would appear he quit posting here. I think I know the story behind it, but I'll let someone who knows it better illuminate. It's spelled out in a thread somewhere.

Beat me to it! I don't see any scratches, clearly, he doesn't want to sell them at $305, shoes look pretty good.

Sounds like he did as you describe. In the end, you can't force a man to walk to the post office and ship shoes to you if he doesn't want to. You have every right to put negative feedback and he is probably expecting it

Veteran Ebay guys can chime in, but maybe you shouldn't have even requested pics? Can you not simply say to him, 'I won the auction, I don't care if they're scratched, just send them to me'? He entered into a contract to sell them and he's in breach if you paid for them and he is refusing to ship them. It is your choice to refuse them if they are not in good condition. It is not his choice to refuse to ship something that he contracted to ship if payment was made.

Why not get eBay involved right away? There's been a lot of talk lately about eBay changing their rules to favour buyers. You should get some action on this.

Classy guy. Tell him you don't care about the scratches because you plan to refinish them, so he should go ahead and fulfill his obligation.

Not condoning his behavior (he is obviously in the wrong) but worse things happen to buyers on eBay. You at least didn't lose any money!

What if he really scratches the shoes to spite him?That would suck.

re-refund the payment back to him. Tell him you've been dying for these shoes and could care less about condition. I had a similar situation, and most sellers would expect you to go gently into the goodnight, but if you are persistant, you may get your way. Also, forget email. Get the guys phone number from the order page and call him direct. You would be surprised that snipiness, snarkiness, and general bad email manners are exponentially reduced once confronted with a surprise phone call.

I consider myself an experienced eBay seller (Power seller) I always honor my deals, even when I loose quite a bit. I recently sold a brand new pair of Alden cap toes for $57. Link. I understand that I have a right to the shoes, but practically, I can't enforce that. I am stuck w/ the only remedies of posting here and leaving negative feedback, both of which get me nowhere.

Again, you can't force a seller to ship something if he claims he doesn't have it or it was catastrophically damaged. I don't care what super policy changes ebay does, they aren't going to inaugurate an In-Home Merchandise Inspection and Fulfillment Guarantee Team. Sure you can ask him to send them to you, scratches and all, but in no way does that force him to do anything.

In the eyes of ebay, once you have received a full refund, you have no further right to items. The only right you have is to leave negative feedback. Yes it's wrong but it is fact

Wow, I did not know that. Not sure how that works legally, since a bid on something is a binding contract, as far as I understood it. Clearly eBay doesn't work like a regular business would.

You guys know better than I. rebel, I kind of figured you were a Powerseller or close to it. Sorry to hear about this.
