so i got a Public Intoxication Misdemeanor on my 21st the other night. i went to pay it today and the lady at the desk said i could pay it and have it stay on my record, or see a judge.

i asked her what the judge would do, but she wouldnt tell me. i asked her what she would do but she said she wasnt able to give legal advice.

so here i am...i come to you SF to inform me on what will happen if i see a judge.

i normally would ask friends/family but this isnt the kind of thing i want too many people knowing.

i have no blemishes on my record, have 1 year of school left, and work at the most prominent bank in town

You may have to pay a bit but it will be worth it. Someone who does this exact sort of thing professionally, in your area, will know what they are talking about. Some corporate guy from NYC or even a crim guy from new jersey or whatever may mislead you. Do things right, schedule a sit down and talk about your options and what they mean.

Not a lawyer. But last time I went and spoke to a judge, he made my fine suck less.

I would track down the arresting officer and plant some evidence on him to discredit his character before going to court.

Been through this a number of times in my drinking/college days. The judge will more than likely offer you some sort of community service / alcohol classes and/or fine in order to have this not go on your "record." It's up to you, I always paid the money because I'm lazy, but then again I have had those strange job forms that require you to list any criminal offenses (even misdemeanors) for the past 10 years or so, and I've always been a bit embarrassed putting that down. I've never not gotten a job because of it, but had I failed to put it down, who knows.. If you've got the time, go see the judge, if not, pony up the money.

bit of an update on this...spoke to a lawyer, friend of a prof that im quite close to, and he suggested speaking with the judge. i told him the usual bs about how i was celebrating my 21st and being out of character. he took it off my record and cut the fine entirely. I just cant have another alcohol related charge in 18 months. also, it turns out that our local newspaper prints all arrests that show up on a police report from the previous night. my name and a 25 word description appeared. i called the paper to demand a follow up piece about how my name was cleared but the refused, saying that they only print what is sent from the station. i know my next step is printing arrests from the previous day common? it really rubbed me the wrong way when i found out about it
