Hit by a Car, Other Insurance Company Stalling, Can I Get a Rental?

Not sure if this appropriate here, but I figure there are lots of lawyers here: I was in an accident where another driver cut across several lanes trying to make a turn and hit me. The police report states what happened as well as the citation issued to the other driver. This accident happened about 12 days ago. I contacted the other insurance company a few hours after the accident. Since then they have done almost nothing to help including rarely if ever return phone calls. The best I got was them to send an adjuster out to look at my car. They claim their party (the other driver) has not responded to them. In the meantime I am without a car and have a difficult time getting to work and so forth. I ultimately involved my insurance company as well about a week after the accident. Am I entitled to a rental until they pay me? If I get a basic rental car on my own, can I expect to reimbursed after they settle? I do not have rental coverage with my policy, but my car is not drivable.

Where do you reside?? Which insurance company are you with?? Which insurance company is the other party with?? I worked for a rental company, and this situation comes up very frequently. Insurance companies are notorious procrastinators, and during this time of year many adjuster are on vacation which slows things to a grinding halt. I would talk to your adjuster and see if they are willing to pay for the rental and seek reimbursement from the other parties insurance company. Most insurance companies where I'm from will usually do this though I have no idea how things work in the US (if that is where you are from...)

I am from the US (GA), the other insurance company is USAA. I'd like a car now, should I just rent one today and talk to my insurance company on Monday?

I'm thinking you're going to have to decide for yourself whether it's worth the risk of getting stuck paying for the rental out of pocket. If the insurance company refuses to pay for the rental, are you really going to take it to court? Until you have authorization, that's the risk you'll be taking.

You could, but as Doc mentioned above, there is a risk that you will pay out of pocket. If you choose to get a rental be sure to get the insurance company rates. I know where I worked that the retail rates were nearly double what the insurance rates were.

I've been in your situation and went ahead with the rental car. Picked the top tier level and the insurance company ended up covering the bill about 2 weeks later. Play the you made me wait and I didn't know what my options were card

I've been through this, too. However, after a few days it turned out that the person who hit me was uninsured thus my own insurance had to cover the rental. Even though the accident was undisputedly not my fault, the whole ordeal was a long and frustratingly arduous process full of uncompensated inconvenience.

The best car story ever hear. I used to work with this woman who ended up going out of town on a two week cruise. She leaves her car with a mechanic/friend of hers to do some work on it and to keep an eye on it. She gets back from her cruise and gets a phone call from her insurance company asking her how she wants to proceed as the result of the car accident she'd been in earlier that week. She informs them that she was on a cruise and couldn't have been in an accident. She goes round and round with the insurance company (providing proof that she was actually on the ship etc) and ends up calling her mechanic friend. It turns out that this guys son is a pizza delivery kid and his car broke down. The mechanic lent this woman's car out so this kid could deliver pizza and he ended up totaling the car.

Crazy shit.

Here is a very general answer. If you have rental coverage on your policy, the cost of the car should be covered and your company should be providing you with a car. Contact your insurance company about that. If it turns out that the other driver is at fault, your insurance company can recover the costs from his insurance company. Understand that a traffic citation is neither an admission of liability nor a finding of liability. It is merely a determination of the officer at the scene as to whom he felt was at fault based on his collection of the facts. That can be disputed.
